Germany: Basic Law update

New amendment passed by Bundestag

Amends Articles 38 and 109

The German Bundestag has passed an amendment to the Basic Law, the country's constitution. The amendment, which was passed with a two-thirds majority, amends Articles 38 and 109 of the Basic Law. Article 38 concerns the right to property, while Article 109 concerns the financial powers of the federal government.

The amendment to Article 38 clarifies that the right to property is not absolute, and that it may be restricted for reasons of public interest. The amendment also introduces a new provision that allows the government to expropriate property for public purposes, subject to compensation.

The amendment to Article 109 gives the federal government new powers to borrow money and to issue bonds. This will allow the government to finance its spending more easily, and will help to reduce the country's deficit.

The amendment is expected to be signed into law by President Frank-Walter Steinmeier in the coming weeks.
